1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "User", or "you") and VeloStats ("we", "us", or "our"), governing your access to and use of the VeloStats analytics service, dashboard, client tracker scripts, APIs, and associated documentation (collectively, the "Service").

By creating an account, embedding the tracking script on your website, or accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of the Service

VeloStats provides a privacy-preserving web analytics platform designed to collect aggregate site telemetry, detect automated bot traffic, measure Core Web Vitals, and generate analytical rollups without using cookies or storing personally identifiable information (PII).

3. Account Registration & Security

To use the Service, you must register for an account. When registering, you agree to:

• Provide an accurate, current, and verifiable email address.
• Maintain the confidentiality and security of your login credentials and authentication sessions.
• Promptly notify us at [email protected] if you detect or suspect any unauthorized access to your account.

You are solely responsible for all activities and telemetry ingested under your account site keys.

4. Acceptable Use Policy

You agree not to use the Service, or permit any third party to use the Service, to:

• Deploy tracking scripts on websites promoting illegal content, malware distribution, phishing, or hate speech.
• Modify or inject custom code into the client tracker designed to extract personal identifiable information (PII) from end users.
• Attempt to reverse-engineer, decompile, or compromise the integrity of our ingestion APIs or backend infrastructure.
• Interfere with, overload, or disrupt the Service through denial-of-service attacks, spam beacon generation, or artificial volume floods.
• Resell, sublicense, or rent access to the Service to third parties without prior written authorization from VeloStats.

5. Plans, Quotas & Fair Use

Service accounts are provisioned with monthly event ingestion quotas corresponding to the chosen subscription tier.

• Quota Calculation: Quotas are measured based on total beacon pings processed by the ingestion engine during each calendar billing cycle.
• Fair Use & Throttling: If your monthly beacon volume consistently exceeds your allocated tier limits, VeloStats reserves the right to rate-limit incoming beacons or request an upgrade to an appropriate enterprise tier.

6. Intellectual Property & Data Ownership

Your Data: You retain complete ownership of all analytics data, domain configurations, and traffic statistics collected from your properties. VeloStats will never sell, monetize, or share your traffic data with advertising networks or third parties.

Our Service: VeloStats and its licensors retain all right, title, and interest in and to the Service, including the tracker script (velo.js), dashboard user interfaces, database architecture, bot heuristics, and brand trademarks.

7. Service Availability & Maintenance

We strive to maintain high availability and reliability for both our beacon ingestion edge and authenticated dashboards. However, the Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, bug-free, or zero-downtime operation, particularly during emergency security updates or upstream datacenter maintenance.

8. Limitation of Liability

To the maximum extent permitted by applicable law, VeloStats and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or replacement costs arising from your use of or inability to use the Service.

In no event shall our total cumulative liability arising under or relating to these Terms exceed the total amounts actually paid by you to VeloStats in the twelve (12) months immediately preceding the event giving rise to the claim.

9. Termination & Account Deletion

You may terminate your account at any time by executing the self-service account deletion procedure in your Account Settings. Upon confirmation, all associated sites, share links, API keys, and database records are permanently and irreversibly purged.

We reserve the right to suspend or terminate your account immediately upon notice if you materially breach these Terms or engage in conduct that threatens the security or stability of our infrastructure.

10. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which VeloStats operates, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms shall be resolved first through informal good-faith negotiation.
